INTERPRETATION – TERMS AND CONDITIONS
The following terms shall have the meanings assigned to them hereunder and cognate terms shall also bear corresponding meanings, namely:
- “Client” shall mean the person(s) who booked a safari/tour directly with the Company, or via a travel agent/tour operator, and who will attend/participate in such a safari/tour.
- “Company” shall mean Moonstroll Vantage Expeditions (herein referred to as Moonstroll), their agents, representatives of any form, members, associates, organisers, subsidiaries, shareholders, directors, agents, employers and employees.
- “Subcontractor” shall mean any person, company, natural or juristic person contracted by the Company for any accommodation, activities or associated activities forming part of the proposed Itinerary.
BOOKING TERMS & CONDITIONS
These conditions apply to all tours provided by Moonstroll. By completing the booking form, you confirm the Terms and Conditions and accept them on behalf of the persons listed in the booking form.
- PAYMENT TERMS

- A booking will only be confirmed upon the receipt of a 35% non-refundable deposit (unless otherwise agreed by both parties in writing).
- Once a booking has been confirmed by Moonstroll or its agent, in writing or by e-mail, all terms and conditions apply and our cancellation policies will be in immediate effect.
- An invoice issued by Moonstroll serves as full confirmation of the booking.
- The full amount of the safari is payable not less than 42 days prior to the date when the safari commences.
- A booking made within 42 days of the commencement of the safari is payable in full on confirmation of the booking.
2. CANCELLATIONS
Note: If you wish to cancel your booking, you must inform Moonstroll in writing. Cancellation will only be deemed effective on the day it is received by Moonstroll.
The following charges will be payable by you depending on the number of days prior to the safari’s departure date when Moonstroll receives the cancellation notice.

- A cancellation fee of 35% of the total cost of the safari if cancelled 42 or more days prior to the safari’s departure date.
- A cancellation fee of 50% of the total cost of the safari if cancelled 28-41 days prior to the safari’s departure date.
- A cancellation fee of 75% of the total cost of the safari if cancelled 14-27 days prior to the safari’s departure date.
- A cancellation fee of 100% of the total cost of the safari if cancelled less than 14 days prior to the safari’s departure date.
3. INCLUSIONS IN AND EXCLUSIONS FROM THE TOUR / ITINERARY
Safari prices include ONLY what is indicated for each tour in the itinerary provided. Therefore, the clients acknowledge and agree that the only services to be provided are those specifically set out on the Invoice/Tour Itinerary, and no more and as a consequence all other experiences that may be had whilst the travel arrangements are in place, are at the cost of the clients.
Thus, the following are not a part of the travel arrangements/tour itinerary:

- personal travel insurance;
- travel insurance;
- visa, passport and vaccination charges;
- airport departure and airline taxes;
- any meals, transport costs, accommodation costs or other expenses that are not included in the travel arrangements/tour itinerary;
- laundry, postage, personal clothing, medical expenses and items of a personal nature;
- emergency evacuation, emergency surcharges and/or costs related to compliance with isolation regulations;
- additional expenses caused by delay, accidents or disruption to planned itineraries;
- tipping and excess baggage charges;
- beverages (unless as otherwise specified in the Invoice/tour itinerary); and
- any item not specifically detailed as included in the travel arrangements/tour itinerary.
4. ALTERATION OF SAFARIS / CHANGES TO TRAVEL ARRANGEMENTS

- The clients acknowledge and agree that for a whole series of reasons Moonstroll may have to alter the travel arrangements up to and including and throughout the travel period.
- If such a change has to be made, and if alternative arrangements can be put in place by Moonstroll, that are of the same quality as those set out in the tour itinerary, Moonstroll will do so. Any increase in costs occasioned by the change will be the subject of an invoice provided by Moonstroll to the clients.
- If such a change has to be made, and alternative arrangements cannot be put in place by Moonstroll, that are of the same quality as those set out in the tour itinerary, the best available alternative will be booked and the clients agree that no claim, or claim for compensation, can or will be made against Moonstroll.
- Furthermore, clients also agree and acknowledge that Moonstroll is not responsible for, nor can it be responsible to the clients, nor will the clients make any claim against Moonstroll, with regard to changes or cancellations to clients’ travel arrangements brought about by decisions of any Government or Governmental Authority relevant to the pandemic or the implementation of travel restrictions directly or indirectly related to or due to a pandemic (the “travel restrictions”). Should such travel restrictions be imposed Moonstroll may have to alter the travel arrangements up to and including and throughout the travel period. The clients agree that no claim, or claim for compensation, can or will be made against Moonstroll.
- Therefore, Moonstroll Vantage Expeditions and any safari company acting on its behalf, reserves the right to withdraw any safari, eliminate any feature or alter the itinerary, should local conditions necessitate.
5. UNUSED PORTIONS OF THE SAFARI TOUR / ITINERARY
The clients acknowledge and agree that the travel arrangements are a package and that the clients cannot choose to cancel portions of the travel arrangement and be refunded in whole or in part for those portions unused or cancelled.
6. CLIENT CONDUCT DURING SAFARI / TOUR

- The client acknowledges that the company will appoint a tour leader/professional guide who shall be in charge of the safari and all matters relating thereto, and the client agrees and undertakes to comply with the professional guide’s/tour leader’s legitimate requirements.
- The client agrees and undertakes that he/she will at all times comply with the company’s requirements in regard to his/her conduct, and he/she will not in any way constitute a nuisance to any other person on the safari.
- If a client constitutes a nuisance to the company or any other passenger, the company shall be entitled to terminate the company’s booking and refuse to permit the client to continue with the itinerary and safari. In this event the client shall be responsible for making his/her own further travel arrangements at his/her own cost. In these circumstances the company shall not be liable to make any refund to the client, who will have no claim of any nature whatsoever against the company.
7. ACCOMMODATION

- We assume that people travelling on their own are prepared to share accommodation. We try to arrange for single travellers to share with someone of the same sex, but cannot guarantee this. Sometimes we have to change the rooming arrangements at the last minute. If it is not possible to arrange a share with another guest, or if you would prefer a single room, you will usually have to pay a single supplement
8. INSURANCE

- It is a booking requirement that all travellers take out comprehensive travel insurance. This should be done at the time your booking is confirmed and your deposit paid. All clients should be fully insured against accident, all medical eventualities, repatriation, cancellation, curtailment and default. Moonstroll Vantage Expeditions or any safari company acting on its behalf cannot be held responsible for loss or damage to baggage and personal effects. This should be covered by your travel insurance policy.
9. PASSPORT AND VISAS

- The clients agree and acknowledge that it is the clients’ obligation, at all times, prior to, at the time of and throughout the tour/safari for the clients to hold the appropriate passport and visas in order to be able to undertake and complete the tour/safari. The clients acknowledge and agree that whilst Moonstroll may assist in the obtaining of the necessary visas to assist the client in being able to undertake the tour/safari, that the rules and regulations in relation to the issue of the visas, particularly in the countries to be visited by the client during the tour/safari, change and do so without notice. The clients agree and acknowledge that although Moonstroll may have assisted the client in obtaining such visas, the client does not rely upon Moonstroll to have provided correct visas that comply with the then-current law of any country which the clients enter, or intend to enter, during the tour/safari.
- The clients have absolute responsibility to the exclusion of Moonstroll to be aware of the rules, regulations and restrictions imposed by any country to be visited by the clients during the tour/safari in relation to the entry, continued visiting within that country, or residence within that country or departure from that country, and to comply with those rules, regulations and restrictions.
10. HEALTH

- Consult your doctor or pharmacist to seek professional medical advice recommended for travel on this safari/tour. All guests must understand that while a high level of fitness is not required, a measure of physical activity is involved in all Moonstroll Vantage Expeditions trips. It is the responsibility of clients to advise us prior to departure of any specific medical conditions. Anti-malaria precautions must be taken, and these are the sole responsibility of the client.
11. RESPONSIBILITY

- Neither Moonstroll Vantage Expeditions nor any person acting for, through or on behalf of Moonstroll Vantage Expeditions shall be liable for any loss or damage whatsoever, arising from any cause whatsoever and without restricting the generality of the foregoing shall particularly not be responsible for loss or damage arising from any errors or omissions contained in these pages or any other literature, late or non-confirmation or acceptance of bookings, loss or damage caused by delays, sickness, injury or death, whether occasioned by negligence or not.
- The person making any booking will, by the making of such a booking, warrant that he or she has authority to enter into a contract on behalf of the other person/s included in such a booking and in the event of the failure of any or all of the other persons so included to make payment, the person making the booking shall by his/her submission of the booking form assume personal liability for the total price of all bookings made by him/her.
12. PHOTOGRAPHY

- Moonstroll Vantage Expeditions reserves the right to use pictures taken on Safari which may contain your image. Moonstroll Vantage Expeditions owns the copyright to all pictures taken by them or on their behalf.
13. SAFARI COMPANIES

- Some safari companies will demand that you agree to their terms and conditions as well as to the terms and conditions already listed above. Their cancellation procedures may also alter. In such a case their conditions will apply and supersedes the terms and conditions of Moonstroll Vantage Expeditions.
14. INDEMNITY AND LIABILITY

- Any safari is potentially hazardous and it is essential that all lawful directions and advice of the safari operator be followed. Moonstroll Vantage Expeditions and any safari company acting on its behalf, accept no responsibility for any illness, accident or loss whatsoever, incurred in the course of the safari or for any expense from such illness, accident or loss.
Furthermore, Moonstroll shall not accept liability for:

- Any changes, omissions or delays before, or during the course of the tour as a result of technical difficulties, weather conditions, communication breakdown or events beyond the control of Moonstroll.
- Any cancellation or curtailment of the tour as a result of the Client’s personal circumstances, e.g., death or illness.
- The Client binds his/her dependants, heirs, trustees, executors, administrators, third parties and/or assigns to the terms and conditions of this document and undertakes to indemnify, hold harmless and expressly exempt Moonstroll from any and all liabilities and/or claims (specially including but not limited to claims arising from personal injuries, death, loss of support, delay, theft, inconvenience, accident, loss, consequential loss, damage to property, medical expenses, funeral and related expenses) arising from any cause whatsoever by virtue of the Client’s participation in the tour.
- The Client waives any and all liabilities and/or claims of whatsoever nature or cause, howsoever arising, which he/she or his/her dependants, heirs, trustees, executors, administrators, third parties and/or assigns might have against Moonstroll and releases Moonstroll against any and all liability and/or claims that may arise or accrue to the Client, his/her dependants, heirs, trustees, executors, administrators, third parties and/or assigns.
